These Terms of Service (the “Terms”) govern your access to and use of the websites, online services, and in‑store services provided by Maison de Sérène ("Maison de Sérène", "we", "us", or "our"). By visiting our site, placing an order, or engaging with us in store at maisondeserene, Parkson, Vientiane, you agree to be bound by these Terms and our other policies referenced here (collectively, the “Agreement”). If you do not agree, you may not use our services.

2. Eligibility & account

  • You must be at least the age of majority in your jurisdiction to make a purchase.

  • You may need to create an account to access certain features. You are responsible for maintaining the confidentiality of your login and for all activities under your account. Notify us of any unauthorized use immediately.

3. Orders, acceptance & availability

  • All orders are offers to purchase subject to our acceptance. We may, at our sole discretion, refuse or cancel any order, including where an item is unavailable, pricing or product information is inaccurate, or suspected fraud is detected.

  • We may limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders placed by or under the same customer account, the same payment card, and/or orders that use the same billing/shipping address.

  • If we cancel or change an order, we will attempt to contact you using the email/phone provided at the time the order was made.

4. Product information; fragrance safety

  • We strive to display colors and details of our products accurately; however, display settings and manufacturing tolerances may cause slight variations.

  • Fragrance products contain alcohol and are flammable. Please follow the safety information on packaging and keep away from heat, sparks, open flames, and hot surfaces.

  • Ingredients lists may change; always refer to the packaging for the most current information, including allergen disclosures.

5. Pricing, taxes & payments

  • Prices are shown in the local currency unless noted otherwise and are subject to change without notice.

  • Applicable taxes and fees will be added at checkout or at the point of sale.

  • We accept the payment methods shown at checkout/in‑store. By submitting a payment method, you represent that you are authorized to use it and authorize us (and our payment processors) to charge the full amount of your order.

6. Shipping, risk of loss & delivery

  • Delivery estimates are provided for convenience and are not guaranteed. Title and risk of loss pass to you upon delivery to the carrier (for online orders) or upon completion of in‑store purchase.

  • Some products may be subject to dangerous goods transportation rules due to alcohol content; available shipping methods and destinations may be limited.

7. Returns, refunds & exchanges

  • Our returns are in‑store only at maisondeserene, Parkson, Vientiane within 7 days of purchase, subject to eligibility conditions.

  • We do not accept mailed returns.

  • Please review our Returns & Refunds Policy for full details, which is incorporated into these Terms by reference.

8. Promotions, gifts & loyalty

  • Promotions and offers are for a limited time and subject to change. Conditions may include minimum spend, eligible products, or one‑per‑customer limits.

  • If a return causes an order to fall below a promotion threshold, the value of gifts with purchase may be deducted or the gift must be returned unopened.

  • Any loyalty, membership, or event program may be modified or terminated in our discretion, with or without notice, to the extent permitted by law.

9. User content & reviews

If you submit reviews, photos, comments, or other content ("User Content"), you grant Maison de Sérène a non‑exclusive, worldwide, royalty‑free license to use, reproduce, publish, translate, and display such content in any media for marketing and promotional purposes, subject to our Privacy Policy. You represent that you own or control all rights in your User Content and that it does not infringe any third‑party rights or contain unlawful, harmful, or misleading material. We may remove or edit User Content in our discretion.

10. Acceptable use & prohibited conduct

You agree not to use our services to, or attempt to:

  • Violate laws or infringe intellectual property, privacy, or other rights;

  • Upload malicious code, interfere with security or operations, or probe, scan, or test vulnerabilities;

  • Misrepresent your identity or affiliation, or engage in fraudulent activity;

  • Collect information of other users without consent;

  • Use any automated means to access the site (scrapers, bots) except for indexing by standard search engines.

11. Intellectual property

All content on our site and in our materials—including trademarks, logos, graphics, photographs, product names, text, and layouts—is owned by or licensed to Maison de Sérène and protected by intellectual property laws. Except as expressly permitted, you may not use our IP without prior written consent. Nothing in these Terms grants you any right, title, or interest in our IP.

12. Third‑party services & links

Our services may include links to third‑party websites or tools operated by others. We are not responsible for their content, policies, or practices. Your use of third‑party services is at your own risk and subject to their terms and privacy policies.

13. Disclaimer of warranties

To the fullest extent permitted by law, our services and all products and content are provided “as is” and “as available,” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non‑infringement. We do not warrant that the services will be uninterrupted, timely, secure, or error‑free, or that defects will be corrected.

14. Limitation of liability

To the fullest extent permitted by law, Maison de Sérène, its directors, officers, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, goodwill, or other intangible losses, arising out of or related to your use of the services or purchase of products. In all cases, our aggregate liability shall not exceed the greater of (a) the amount you paid for the product giving rise to the claim, or (b) USD $100.

15. Indemnification

You agree to indemnify, defend, and hold harmless Maison de Sérène and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your breach of these Terms or the documents they incorporate by reference, your violation of any law or third‑party right, or your use of the services.

16. Force majeure

We will not be liable for any delay or failure to perform due to causes beyond our reasonable control, including acts of God, fire, flood, explosion, war, terrorism, labor disputes, government action, network or utility failures, or shortages of transportation or materials.

17. Governing law & jurisdiction

This Agreement is governed by the laws of Lao PDR, without regard to conflict‑of‑law principles. You and Maison de Sérène agree to submit to the exclusive jurisdiction of the courts located in Vientiane, Lao PDR, for any dispute arising out of or relating to these Terms, subject to any mandatory consumer protection rights.

18. Changes to the Services and to these Terms

We may update these Terms and/or modify or discontinue the Services at any time. When we make material changes, we will post the updated Terms and update the Effective date above. Your continued use of the Services after changes take effect constitutes acceptance of the new Terms.

19. Termination

We may suspend or terminate your access to the Services at any time and for any reason, including if we believe you have violated these Terms. Sections that by their nature should survive termination (including IP, disclaimers, limitations of liability, indemnification, and governing law) will survive.

20. Miscellaneous

  • Entire agreement. These Terms, together with the policies referenced herein, constitute the entire agreement between you and Maison de Sérène regarding the Services.

  • Severability. If any provision is found unenforceable, the remaining provisions will remain in full force and effect.

  • No waiver. Our failure to enforce any right or provision shall not be a waiver of such right or provision.

  • Assignment. You may not assign or transfer any rights under these Terms without our prior written consent. We may assign our rights and obligations in connection with a merger, acquisition, or sale of assets.
